Musician Claims $5.2 Billion In Damages In Copyright Infringement Lawsuit Against Apple, Amazon

Techdirt- The laws surrounding IP can certainly be absurd, and the ever-extending copyright term has turned the phrase "for a limited time" into a joke in search of a punchline. But there's nothing so absurd as those who take these laws into their own hands, find a lawyer willing to represent fools and pursue supposed infringement in court.

The whole patent, copyright, everything needs to be re-worked.

It doesn't even protect the little guy anymore. Companies just watch submissions then utilize their big budget lawyers to steal it. A lot of people don't even bother submitting anymore because its so flawed at this point.

It seems the only people utilizing the system are little guys trying to get rich off stupid crap, or for big companies to sue each other constantly.

There needs to be rules.

-There needs to be a standard fee. You create the patent, the patent company creates the standard fee. If its tech related and utilized heavily, the fee is higher. if its sitting there for years, its lower. The fee is standard across the board and only needs to be paid once, not per unit sold.

-There needs to be rules as to what is "similar" and what is "exactly the same." This way we stop seeing "bla bla sued by some random guy that patented a general idea 20 years ago"

-it needs rules as to when its utilized. If something never hits the market 5 years after being patented, the patent is now free to use by anyone paying the standard fee. No exclusive right anymore.

-No exclusive right over general ideas that could improve society as a whole. The patents fall into the fee area so you can't hold them hostage.

As for copyright, I don't even know how to approach this because its so flawed. For starters we need to give rights to artists, not publishers. Then we need to tone down the fines for it. Going to prison for years for stealing a movie, but getting a slap on the wrist for DUI and assault? What?

I love this sort of claim, they always pursue some wildly unrealistic sum and then settle for about $10k.

I think it must be the lawyers who sit behind their desks and do their best Dr Evil impression. One million dollars? No!
