French blogger fined $3,400 for bad review…because it was too popular

Caroline Doudet, the owner of Cultur’elle (a French blog) was ordered by a judge to change the title of a negative review about Il Giardino, an Italian restaurant in the south western section of France. She was also required to pay $3,400 for damages and interest.

Yea I was totally confused as to how they managed to win that case based on what the law described. I guess they tried to argue that because they were a small business and couldn't afford lawyers and PR people, they couldn't stand a chance against one bad review. Silly though. It's clearly backfired because now when you Google the restaurant name, every post is about how they sued a single blogger. Serves them right.

im not sure if this was a corporation, just seems to be a local restaurant. however, it is sad that the blogger is getting punished for expressing their honest opinions with no malice.

It's really no fun being a blogger in France..

its harsh. sort of like the big picking on the weak. is the restaurant a very known place?

the blogger did seem genuine and sounded like there was no other motif other than to express their experiences and opinions to their readers so that they can warn other people. the translation was bad. but it did sound like they have been there before and have enjoyed it.

i can see why restaurant owners can be suspicious or scared of bloggers with bad reviews though. some can actually be from rival restaurants to try and ruin their businesses.

There's absolutely no reason anyone should be fined over a genuine review.

The problem being that internet anonymity basically makes it impossible to prove if a review is genuine.

Plus, if N4G is any indication, the general public has absolutely NO CLUE how to interpret reviews nowadays. A negative review from a popular source can absolutely ruin it's subject, regardless of how subjective it all is (especially for something like food).

Just think of how many good games have been released that were instantly deflated before release because of some negative press.
